Brinkhof advises and represents clients in relation to regulatory investigations and litigation at the European Commission, EU courts and other EU regulatory and judicial bodies. We quickly put together sizeable teams with complementary skills, combining subject-matter expertise – for example in competition, intellectual property, media, online platform regulation, privacy, or telecommunications – with the EU institutional, procedural and litigation knowhow to deal with any regulatory investigation or EU litigation challenge.
Informal and adversarial interactions
Our work in this field encompasses informal and adversarial interactions with a range of regulatory authorities, including the European Commission and specialist bodies such as the EDPB, ERGA and BEREC, as well as direct appeals and preliminary reference proceeding at the CJEU. Our areas of substantive focus include Articles 101 and 102 TFEU, TRIS notifications, GDPR, EECC, DSA, DMA, AVMSD, EUTM, and SPCs.
Strategic litigation and business impact
We also regularly advise on strategic litigation options aimed at proactively clarifying issues of EU law with significant business impact, and design and coordinate litigation strategies across EU member states. For example, we advise a range of multinational technology and media clients on their pan-EU compliance and litigation strategy with respect to the EU Copyright Directive, GDPR, and platform content laws.
